1. Accuracy and completeness of information provided by the client
2. Availability of third-party data
3. Cooperation (or lack thereof) from external parties
4. Time delays
5. Legal, technical, or jurisdictional limitations

Apex Intelligence makes no representations, warranties, promises, or assurances of any kind regarding:

1. Successful outcomes
2. Recovery of assets
3. Identification of persons
4. Confirmation of suspicions
5. Locating missing persons
6. Collection of admissible evidence
7. Criminal, civil, or disciplinary consequences

The existence of millions of unresolved investigations and cold cases worldwide demonstrates that investigative work is never guaranteed.

Apex Intelligence undertakes to apply reasonable skill, experience, diligence, and lawful methods — nothing more, nothing less.

4. No Legal Advice or Law Enforcement Role

Apex Intelligence is not a law firm, attorney, advocate, law enforcement agency, or prosecuting authority.

No information provided constitutes legal advice, legal opinion, or a substitute for consulting a qualified legal practitioner.

5. Client Responsibilities

Clients acknowledge and agree that:

1. All information supplied must be truthful and accurate
2. False or misleading information may render investigations ineffective
3. Clients remain solely responsible for how any information is used
4. Clients must obtain independent legal advice where necessary

6. Limitation of Liability

To the fullest extent permitted by South African law:

1. Apex Intelligence shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages
2. This includes loss of money, property, opportunity, reputation, emotional distress, or expectations
3. Total liability, if any, is strictly limited to the amount actually paid for the specific service rendered

7. Indemnity

You hereby indemnify and hold harmless Apex Intelligence, its directors, associates, contractors, and representatives from any claims, losses, damages, costs, or legal actions arising from:

1. Your use of this website
2. Your reliance on any information provided
3. Your misuse of investigative outputs
4. Your breach of these Terms

8. POPIA & Confidentiality

Personal information is processed lawfully in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

Information is used solely for investigation, record-keeping, compliance, and service delivery.

9. Electronic Communications & Signatures

All electronic communications, submissions, and acknowledgements are valid under the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

10. No Reliance Clause

You expressly agree that you do not rely on any statements, representations, assumptions, or expectations not explicitly stated in these Terms.

11. Governing Law

These Terms are governed exclusively by the laws of the Republic of South Africa. South African courts shall have exclusive jurisdiction.

12. Final Acknowledgement

By continuing to use this website or engaging Apex Intelligence in any manner, you confirm that you understand and accept that investigations are uncertain, outcomes are never guaranteed, and all services are provided on a best-effort, lawful, and ethical basis only.
